Copyright Policy

INKO.RUN respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to valid notices of copyright infringement.

This policy outlines the procedures for reporting copyright infringement and our response process.

1. Reporting Copyright Infringement

If you believe that content on INKO.RUN infringes your copyright, please send a written notice to our designated DMCA Agent with the following information:

Required Information for DMCA Notice

  1. Identification of the copyrighted work:
    Describe the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, provide a representative list.
  2. Identification of the infringing material:
    Provide the URL(s) or other specific location of the allegedly infringing content on INKO.RUN so we can locate it.
  3. Your contact information:
    Include your name, address, telephone number, and email address.
  4. Good faith statement:
    Include the following statement: "I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  5. Accuracy statement:
    Include the following statement: "The information in this notice is accurate, and under penalty of perjury, I am the copyright owner or authorized to act on behalf of the copyright owner."
  6. Physical or electronic signature:
    Provide your physical or electronic signature.

Note: DMCA notices may be forwarded to the user who posted the allegedly infringing content.

2. Counter-Notification Procedure

If you believe your content was removed or disabled by mistake or misidentification, you may file a counter-notification with the following information:

Required Information for Counter-Notice

  1. Your contact information:
    Name, address, telephone number, and email address.
  2. Identification of removed content:
    Describe the content that was removed or disabled, and the location where it appeared before removal.
  3. Good faith statement:
    Include the following statement under penalty of perjury: "I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification."
  4. Consent to jurisdiction:
    Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., for any judicial district in which INKO.RUN may be found), and that you will accept service of process from the person who filed the original DMCA notice or their agent.
  5. Physical or electronic signature:
    Provide your physical or electronic signature.

3. Our Response Process

Upon Receiving a DMCA Notice

  • We will review the notice for completeness and validity
  • If valid, we will remove or disable access to the allegedly infringing content
  • We will notify the user who posted the content
  • The notice may be forwarded to the affected user

Upon Receiving a Counter-Notice

  • We will forward the counter-notice to the original complainant
  • We will inform them they have 10 business days to seek a court order restraining the user from engaging in infringing activity
  • If no court order is received within 10-14 business days, we may restore the removed content

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, accounts of users who are repeat infringers. We may also, at our sole discretion, limit access to the Platform for users who have repeatedly been accused of infringement, even if the claims have not been proven.

4. Misrepresentation Warning

Please be aware that under Section 512(f) of the DMCA, you may be liable for damages if you knowingly materially misrepresent that:

  • Material or activity is infringing, or
  • Material or activity was removed or disabled by mistake or misidentification

Before submitting a DMCA notice or counter-notice, please ensure you have a good faith basis for your claim.

5. Trademark Policy

If you believe content on INKO.RUN infringes your trademark rights, please send a notice to legal@inko.run with:

  • Description of your trademark and registration information
  • Description of how the content infringes your trademark
  • Location of the allegedly infringing content
  • Your contact information and signature

All INKO.RUN users must:

  • Only upload content you have the right to share
  • Respect copyrights, trademarks, and other intellectual property rights
  • Provide proper attribution when required
  • Comply with fair use and other copyright exceptions appropriately
  • Remove content promptly if you lose the right to share it

8. DMCA Safe Harbor

INKO.RUN qualifies for DMCA safe harbor protection as a service provider under 17 U.S.C. § 512(c). We do not have actual knowledge of infringing activity and act expeditiously to remove or disable access to allegedly infringing material upon receiving proper notice.

We do not receive financial benefit directly attributable to infringing activity and have implemented this policy to address repeat infringers.
